Attorney General Patrick Morrisey Announces Opioid Settlement Plan

No money is rolling in yet, but West Virginia’s attorney general announced that an agreement has been reached on how any settlement funds or judgments received over opioid litigation would be distributed among the state’s cities and counties. Attorney General Patrick Morrisey said a private, nonstock, nonprofit foundation would be created to distribute the settlement or judgment funds awarded. The foundation would receive 72.5% of the settlement or judgment, 24.5% of settlement and judgment dollars would be allocated to local governments and 3% would be held in escrow by the state. Money would be available for an opioid abatement fund and will be distributed throughout six regions in the state. A board of 11 members would manage the foundation.
