A Nicholas County magistrate found probable cause on Monday to move the case of a man accused in the murder of a Nicholas County sheriff’s deputy to a grand jury. The magistrate ruled in the case of Brent Kelly who is charged with first-degree murder in the June 3 shooting death of Deputy Tom Baker. Baker died following the shooting and Cpl. J. Ellison was injured. Suspect Ritchie Holcomb died in the shootout after deputies responded to a domestic disturbance in the Birch River area. Kelly’s case now heads to a grand jury.
