Kanawha County prosecutors said officers involved in a shootout with a man in Cross Lanes in September that resulted in his death were justified. The Kanawha County Prosecutor’s Office said deputies who shot and killed Brian Spencer of Sissonville were cleared. Spencer was fatally shot by deputies after he fired at them from his vehicle Sept. 23 near the Rodeway Inn in Cross Lanes. Deputies were attempting to locate Spencer, who was wanted on a drug-related warrant out of Logan County. They said he began shooting at them when they attempted a traffic stop. Spencer was shot when deputies returned fire. Prosecutors said he was removed from the vehicle and provided aid, but ultimately died.
