State files suit against a Boone County business for failing to deliver

West Virginia has filed a lawsuit against a Boone County man after several complaints were filed against his business for failing to provide material that customers paid for. The lawsuit stems from 23 formal complaints filed against Douglas Baisden who allegedly sold shed and barn building kits as Build a Barn, LLC. and Barnyard Building Supplies LLC, without providing customers with the material after receiving payment, according to the West Virginia Attorney General’s Office. According to the news release, complaints cited several customers requested refunds, but Baisden would make excuses or cut off contact with the customer. Eyewitness News said the lawsuit asks for financial restitution to eligible consumers, as well as civil penalties and attorney’s fees. It also requests a permanent ban on Baisden from accepting payments for goods that are shipped in the future, citing the West Virginia Consumer Credit and Protection Act.
