A former Cross Lanes daycare employee who was accused of battery and assault on disabled children in her classroom has accepted a plea deal in the case. Amber Seiler, 30, of Poca was indicted in March on eight counts. The charges included two counts of battery and assault of a disabled child, a felony, and six counts of misdemeanor battery. On Monday, Seiler accepted a Kennedy Plea to one count of battery and assault of a disabled child. A Kennedy Plea allows a defendant to plead guilty while maintaining their innocence, acknowledging the prosecution has enough evidence for a conviction.”She does acknowledge that the state does have evidence that could result in a conviction potentially on multiple charges,” defense attorney Justin Collin told Judge Kenneth Ballard during the hearing. Kanawha County prosecutors have agreed to stand silent at Seiler’s sentencing hearing, where she could face between one and five years in prison. Prosecutors also dismissed the remaining seven counts of the indictment in exchange for the plea.
