Attorneys General support an injured Army soldier in court battle

West Virginia Attorney General JB McCuskey is leading a bipartisan coalition urging the U.S. Supreme Court to hear the case of a wounded Army veteran injured in a 2016 bombing in Afghanistan.

Specialist Winston Hencely was hurt when a former Taliban member — hired by U.S. contractor Fluor Corporation — carried out a suicide attack at Bagram Airfield, killing five and injuring 16.

Hencely sued Fluor, claiming negligence. But lower courts dismissed the case, saying contractors can’t be sued for actions tied to combat.

McCuskey and 19 other attorneys general argue that ruling misinterprets federal law — and could shield military contractors from accountability. They’re asking the high court to let the case move forward.
