Mingo county man willl have to wait for judge’s decision to move trial

A Mingo County man accused of fatally shooting a West Virginia trooper appeared in court Tuesday for motions on a change of venue and jury questionnaires ahead of his trial. Timothy Kennedy, of Matewan is facing a five-count indictment that includes the murder of West Virginia State Police Sgt. Cory Maynard, who responded to a shooting incident in the Beech Creek area of Mingo County in 2023. The defense has requested the case be moved to McDowell county. Judge Joshua Butcher said he wouldn’t rule on moving the trial out of Mingo County until he looks into prospective jurors being questioned by court. Judge Butcher will call upon a pool of 100, more than twice the normal amount, to find a fair and impartial jury.
