A bill passed in the West Virginia House Friday that would increase regulations on vape and smoke shops. It’s known as The Vape Safety Act of 2026, requiring vape products sold in West Virginia must already have a federal FDA marketing authorization or a pending application under FDA review to be included in a new state directory. Only products listed in that directory could be sold starting September 16 if the bill become a law. The legislation would keep vape shops away from schools, churches and libraries, limiting youth-based marketing.
