The Vape Safety Act of 2026 cleared the West Virginia House of Delegates on Friday in an 88-5 vote.
The bill strengthens licensing requirements for shop owners and creates an FDA registry to ensure all products sold are federally approved. Eyewitness News reported the goal is to prevent dangerous products — including those with excessive nicotine levels — from reaching minors.
Lawmakers also want to limit marketing tactics they say appeal to teens. Del. Hollis Lewis, D-Kanawha, said many shops are designed to attract young people with colorful displays and flavored products.
The legislation would also prohibit vape shops from operating within 300 feet of schools, libraries, or churches.
