A Bill Would Set Custody Arrangements at 50/50

The West Virginia House of Delegates passed a bill Monday that would require initial child custody arrangements to be 50/50 between parents. House Bill 2363, the “Best Interest of the Child Protection Act of 2021,” now goes to the Senate for consideration. According to the Legislature’s website, the bill stipulates that to change the 50/50 split, one parent must prove the other to be incompetent, neglectful or abusive. The bill would allow for petitions to reopen already settled custody cases.
