A Kanawha County Circuit Court judge has issued a preliminary injunction blocking charter schools. Judge Jennifer Bailey handed down the ruling Monday after two parents, who are also members of the American Federation of Teachers-West Virginia, contended the West Virginia Constitution required a public vote. A lawyer for Gov. Jim Justice and the Legislature have argued they sued the wrong people and said the legal action should have been filed against the Professional Charter School Board. The Legislature created the Professional Charter School Board with power to approve charters after two county school boards killed proposed charter schools in their districts. Nitro Preparatory Academy would go into the old Nitro High School, but that is on hold now with the ruling issuing a preliminary injunction.
