Settlement reached with inmates in class-action lawsuit

A settlement was reached this week between the state and inmates suing as part of a class-action lawsuit over conditions at the Southern Regional Jail. In the order issued by U.S. District Judge Frank Volk, the plaintiffs reached a settlement with named defendants including former West Virginia Division of Corrections and Rehabilitation Commissioner Betsy Jividen, former state Department of Homeland Security Secretary Jeff Sandy, former interim corrections commissioner Brad Douglas, current corrections commissioner William Marshall, and former Southern Regional Jail superintendent Michael Francis. The settlement does not include the other parties in the lawsuit which are the medical providers to the jail, Primecare and Wexford, and the county commissions that house inmates at the facility. Those counties include: Greenbrier, Raleigh, Wyoming, Fayette, Mercer, Monroe and Summers. Volk has scheduled a status hearing for today (Thursday) at 12:30 p.m.
