A man accused of fatally shooting a West Virginia State Police trooper will remain in jail without bond. Timothy Kennedy’s motion to go on home confinement was denied in Mingo County Circuit Court this week. Kennedy pleaded not guilty to charges in connection with the June 2023 death of Sgt. Cory Maynard, who was killed responding to a call in the Beech Creek area of Mingo County. A change of venue motion was expected Wednesday, but Shawn Bayliss, the attorney representing Kennedy, said the defense will hold off to build a case. Bayliss said he wants to hire a public relations firm to help sift through millions of online posts about the case to justify moving it out of the county. The defense is also seeking another competency evaluation. Although a September 2023 exam found Kennedy competent enough to stand trial, attorneys have noted “huge gaps” in his cognitive ability and periods of psychosis. A trial has been set for Sept. 3.
