West VA Supreme Court finds in favor of state’s public transit agencies

This week the West Virginia Supreme Court delivered a triumph to the state’s 18 public transit agencies that cover 32 counties, employ more than 600 state residents and deliver more than 5 million passenger trips a year. Justice John Hutchison delivered the unanimous opinion that further establishes the law for the duty owed to patrons by transit agencies. Specifically, the decision gives firm decision on when that duty begins, when it’s still in place, and when it ends. This was a setback for a woman who had sued the Kanawha Valley Regional Transportation Authority after she was struck and injured in 2019, by an automobile while crossing a street after exiting a bus in Elkview.
