Charges dropped against Milton couple related to an infant’s death

A couple accused in the death of a 3-month-old in Milton have been released from jail after a judge found insufficient evidence in the case. Eyewitness News said Cabell County Magistrate Chris Sperry found no probable cause in the case against Cody Dale Wilson and Trisha Lynn Grigson, who were originally charged with child abuse causing death after an infant in their care died. The judge heard testimony from the infant’s mother and from police who described head trauma and bruising on the infant consistent with choking, but said there was ultimately not enough evidence to prove who did what and how. The case against Wilson, the infant’s father, and Grigson, his girlfriend, will be dropped as a result of the ruling and they will be released from jail. A statement made to first responders indicated the child was in a baby swing when breathing difficulties began and Grigson started to administer CPR on May 23. Police said the infant was taken to a local intensive care unit where he later died.
