A hidden camera in the women’s locker room at the West Virginia State Police Academy is the centerpiece of civil lawsuits in which more than 100 plaintiffs are suing the agency for damages. Eyewitness News obtained a letter from the firm defending the agency. In the letter, Spilman, Thomas & Battle attorney Don Parker to West Virginia’s attorney general, State Police superintendent and secretary of Homeland Security, copied to defendants and plaintiffs, claims the insurance company holding policies for the State Police should have limited responsibility in connection to allegations of secret recordings and destruction of evidence at the State Police Academy. The filing also states that the insurance company claims that no matter how many plaintiffs there are, if it is ordered to pay damages, those damages should not total more than $1 million. More than 80 Jane Doe plaintiffs are listed in the letter, with several other plaintiffs identified by name. It will be up the judge to decide who might be liable for damages should that be the result of trial.
