The Park Avenue Motel in Danville is shutting down. Owner Ken Weaver ran the business for years with his mother and brother, and Eyewitness News spoke with a tenant who wants his security deposit back. Eyewitness News confirmed Weaver has taken no court action to have the residents evicted — something state law says he must do. State code says a person who wants to remove a tenant can do so through the county’s magistrate or circuit court and a tenant has the right to contest. Weaver left a note on the door of each apartment saying that power, water and sewer will be disconnected within the next few days and the premises needed to be vacated immediately. A state law passed in 2011 requires landlords to return damage deposits in full or send a written notice itemizing any alleged damages within 60 days of the move.
