Convictions upheld in 8-year old girl’s death

The West Virginia Supreme Court of Appeals upheld a 2022 ruling of a Fayette County Circuit Court in a case involving the death of an 8-year-old girl. The girl’s father, Marty Browning, his wife Julie Titchenell and the girl’s sister, Sherie Titchenell face charges in her death. The jury acquitted the defendants on an abuse charge in a six-day joint trial, but all three were convicted of neglect. The girl died in 2016 of sepsis caused by pneumonia, according to an autopsy report. Testimony from medical experts showed the girl did not receive medical treatment, despite exhibiting clear symptoms. Eyewitness News said evidence showed the girl was malnourished and dehydrated. In rejecting the appeal, the high court found “no substantial question of law and no prejudicial error.”
