Judge declares mistrial in shooting death of State trooper due to jurors discussing the case

After four days of jury selection, a judge has declared a mistrial in the case of a man accused of murdering a West Virginia trooper in Mingo County.Timothy Kennedy, of Matewan is accused of killing West Virginia State Police Sgt. Corey Maynard as he responded to a shooting in the Beech Creek area in 2023. Kennedy was taken into custody several hours later after a massive manhunt. A mistrial was declared Thursday due to possible juror misconduct after dozens of jurors had been questioned. Court officials said jurors were talking to each other about the case. The murder trial has been continued numerous times with the defense attempting to move the case to McDowell County. Judge Joshua Butcher has not ruled on possibly moving the trial and called in a large pool of candidates to seat a Mingo County jury before the trial was set to start next week.. A new trial date has not been set.
