West Virginia judge has granted a temporary restraining order halting the state’s sale of its four hospitals at the end of the month.Marion County Circuit Court Judge Matthew S. Delligati issued the order Friday in response to a lawsuit filed on behalf of Mary DeVito, a resident of the John Manchin Sr. Health Care Center in Fairmont, which is included in the proposed sale, according to court documents.The order issued by Delligati temporarily stops West Virginia Gov. Patrick Morrisey and cabinet secretary Michael Caruso from completing the sale of the Fairmont facility one in Mason County, one in Preston County, and one in Raleigh County – on Oct. 31 pending further review of the lawsuit. “The Court finds that Plaintiff will likely suffer irreparable harm if the sale of the John Manchin facility is finalised and assets and operations are transferred to Marx Development Group, based on concerns including, but not limited to quality and availability of care for residents, the future of the John Manchin facility and staffing issues,” the judge wrote in the ruling.
