Supreme Court Reverses Decision Involving Nitro Police Officer’s Termination

The West Virginia Supreme Court reversed a Kanawha County Circuit Court order that found that the termination of a man as a police officer for the city of Nitro was appropriate. In the ruling the court reinstated a Nitro Police Department Civil Service Commission’s 2019 order that ruled Timothy Jarrell was improperly terminated from the Nitro Police Department after being accused of putting a man in a chokehold during an arrest. Jarrell appealed the order from Kanawha County Circuit Court that had overruled that decision. In its ruling, the Supreme Court said it concluded that it was error for the circuit court to have reversed and vacated the commission’s order and it should be reinstated.
