Former Marshall Student’s Conviction is Upheld

The West Virginia Supreme Court upheld the rape conviction of a former Marshall University student this week. Joseph Hardin was convicted in 2020 on two counts of second-degree sexual assault and he was acquitted on two counts of sexual assault. The two guilty counts pertained to one victim; the two not guilty counts pertained to another alleged victim. Both incidents happened on separate dates in 2018 but did not occur on campus. All five justices upheld the conviction in a decision handed down Wednesday. Hardin is serving a 20 to 50 year prison sentence.
