A bill working its way through the Kentucky Legislature would make stealing a package from someone’s porch a felony. Right now, it is a misdemeanor in most cases and does not fall under felony mail theft because the law has not been updated in decades. Felony charges are filed only if the package is delivered by the United States Postal Service, because that is all that existed at the time the original law was drafted. Services such as FedEx, UPS and Amazon were uncommon or had yet to be founded. If Senate Bill 23 is passed, the penalty would be one to five years in prison.
