Possible New Witness Comes Forward in Rand Man’s Murder Case

A Rand man convicted of murder and other charges in a deadly shooting is asking for a new trial after his attorney says a new witness has now come forward claiming the shooter was someone else. Gerard Maxwell was convicted after a bench trial, which he requested, last December. Kanawha Circuit Court Judge Kenneth Ballard found Maxwell gunned down Marian Chapman on the porch of a Rand home in Jan. 2019. A motion by his attorney said a new witness, Bernard Johnson, had come forward claiming he saw a skinny Black male, not Maxwell, shoot the victim more than four times. Prosecutors say theh witness is not credible. The judge said he will making a ruling in the case before June 29.
