Lawsuit is pending over the backyard animal issue in South Charleston

Residents in South Charleston have been asking the city if they can keep bees and chickens in their yards, but the city denied the permits. Now, a lawsuit against the city in Kanawha County Circuit Court accuses the South Charleston Property Board of discrimination and acting against their own ordinance. Susan Casdorph, who lives in South Charleston, has applied to keep chickens in her yard twice. Both times, the application was denied. Eyewitness News said Casdorph’s lawyer maintains that the South Charleston government is overreaching and abusing its power. South Charleston’s city code states that a resident can only keep animals–other than dogs, cats, and caged birds–if they receive a permit from the property board. The lawsuit is pending.
