Brent Tyler Kelly being tried for June 2022 murder of sheriff’s deputy

A circuit court judge ruled Friday against sending out a pre-trial question sheet to potential jurors in the murder trial of Brent Tyler Kelly. Kelly, along with Richie Holcomb, 36, were using an RV in the Birch River area when deputies responded to the vehicle and a shootout ensued, killing Nicholas County Sheriff’s Deputy Thomas Baker in June 2022. Holcomb was also killed. Kelly is facing charges of murder, two counts of attempted murder, four counts of wanton endangerment and conspiracy. He pleaded not guilty in May 2023. Judge Jack Alsop ruled Friday that lawyers will be permitted to individually question a panel of 75 jurors for a July 23 trial. A change of venue has not been requested in the high-profile case.
