State can move forward with sale of four hospitals after court ruling

A Marion County judge has lifted a restraining order that previously halted the sale of the state’s four long-term care facilities. WCHS TV said the move now greenlights the state to go through with the sale on Friday. The question that was the central part of the case is whether or not the Department of Health Facilities Secretary Michael Caruso and Gov. Patrick Morrisey had the power to sell the hospitals to a private company without approval from legislators. Marion County Judge Matthew Deligatti said at the end of the more than two hour hearing, he felt the wording in state code was clear that it did give the state the ability to sell. The four long-term care facilities including Manchin, Jackie Withrow Hospital in Beckley, Lakin Hospital in Mason County and Hopemont Hospital In Preston County, are set to be sold for $60 million on October 31 to the New York-based Marx Development Group and its nursing home company Majestic Care, who will oversee day to day operations.
