West Virginia faces a lawsuit over food dye ban

A national food coloring company is suing the State of West Virginia over its recent ban on several food dyes. The International Association of Color Manufacturers filed the lawsuit in federal court, arguing the law violates both state and U.S. constitutions by overriding FDA authority and disrupting interstate commerce. The ban, signed by Governor Patrick Morrisey, prohibits dyes like Red 40, Yellow 5, and Blue 1 in school meals starting next August and in all food statewide by 2028. IACM claims the ban isn’t backed by science and could harm businesses and consumer confidence.
