According to a news release from the Upshur County Sheriff’s Office, a man is accused of trying to kick down the door of another man’s home in Upshur County, leading to an exchange of gunfire between the two. Austin Wayne Arbogast, 24, of Buckhannon is charged with attempted murder, malicious wounding, wanton endangerment, presentation of a firearm during the commission of a felony and attempted burglary. Arbogast is accused of going to the home of Joseph H. Bosley Jr. in the 2000 block of Bailey Ridge Road on Wednesday in an attempt to forcibly take his 5-month-old biological son who was in the home. Witnesses said Arbogast stated he would kill the entire family, When he attempted to kick down the front door, deputies said Bosley fired a handgun from inside the residence, striking Arbogast. Bosley then stepped out on the front porch and Arbogast fired, striking Bosley in the lower abdomen. Investigators said the bullet went through Bosley and into the home, endangering those inside. Arbogast remains hospitalized in critical condition. There is no information on Bosley’s condition
